Asked 8/2/2016 – Irving, TX
Don’t know the full details, they are charging my brother with burning his wife’s vehicle. They are separated and she is saying things to get him in trouble.
Answer
Texas Penal Code Section 28.02 deals with arson. Generally this is either a 2nd degree or state jail felony, but this can change with the specific facts of the case. The exact charge that will be filed is determined by the District Attorney. 2nd degree felonies are punishable by a fine of up to $10,000, confinement in prison from 2 to 20 years, or a maximum probationary period for up to 10 years. Talk with a local attorney soon.
