Asked 8/2/2016 – Austin, TX

Was driving down an access road when this truck pulled into my lane in front of me, despite my slowing down the guy didn’t speed up at all causing me to rear end him- because he was fully in the lane the officer who arrived 15 minutes later (and talked to the other guy first) cited me with “failure to maintain assured safe distance. There was someone in the other lane and I slowed as much as I could- the guy didn’t look before entering the major road from a side road… I have several points on my record. Do I fight this- or ask for deferred disposition.

Answer

The decision on whether to have a trial is up to you. Do you want to take the risk of losing and having more points on your record? Get a copy of the complaint filed, make sure of the exact charge against you, review the statute allegedly violated, and make your decision.
