Asked 8/3/2016 – Dallas, TX

I failed a few drug tests while on probation, my po filed a motion to revoke. What are my best chances to stay out of prison? Should I leave the country? Go to rehab and hope for another chance? Just need some advice.

Answer

The statute of limitations is tolled when the charging instrument is filed in a case, so that issue does not apply in your situation. Leaving the country means you will never be able to return, and virtually guarantees that you will be sent to prison if you are ever apprehended. Start talking with local attorneys. You will need to have one retained before you are arrested. Dallas County Adult Probation and the District Attorney have a policy of not negotiating probation revocation cases until the probationer is in custody, so you will have to retain your attorney, then turn yourself into jail before that attorney case see if drug rehab is an option.
