Shouldn’t the charge be possession of a dangerous drug not possession of a controlled substance?

Asked 8/4/2016 – Corpus Christi, TX

A 2mg Xanax broken into 3 pieces was found in a bag. I was charged with possession of a controlled substance and the degree was based on the weight of the pills. That is incorrect, right?

Answer

The determination of what charges will be filed regarding any defendant is up to the intake department of the District Attorney’s office. If they feel the felony charge is appropriate, so be it. You have the right to contest the allegations as charged. Contact a local attorney soon.
