Asked 8/8/2016 – Fort Worth, TX

Friend is in county jail, awaiting sentencing or plea deal at court date in a few weeks, will she receive credit for time served in county if she goes to state jail? If so is it 2 for 1, day for day, or what? She’s been in county for 3 months now,

Answer

Your friend will be given credit for all the time she has spent in county jail towards any sentence imposed on her state jail case. State jail cases, however, are day for day regarding jail credit, so there will be no 2 for 1 credit. If she has been in jail for 90 days, she will get 90 days credit on her sentence.
