Asked 8/8/2016 – Edinburg, TX

The arrest took place in 2011. I received a deferred sentence after completing my probation. upon completion I retained counsel to assist with an order of non-disclosure. The order was signed on 2012. 4 years later I come to find out the county publicly lists my arrest record online. I was under the impression that my arrest and criminal records would not be disclosed to the public with the order of non-disclosure.

Answer

If an order of non-disclosure was entered, county records of the matter should not be available to the general public. Verify that it is the County that is listing the records and not a 3rd party service, and then contact your attorney.
