Asked 8/9/2016 – Wills Point, TX

I charged my daughter for the unauthorized use of my (second) car and charging $95 on my child support card. She was arrested on 07/13/16. I got my car back 07/14. And she made arrangements for me to get the $95 back. Today is 08/08

Answer

You do not have the ability to force the State to drop any criminal proceedings. Once the police become involved, you lose control of how matters will proceed. If the State believes an offense has been committed and further believes enough evidence exists, criminal charges will proceed even if a complaining witness wants to “drop charges” or has filed an affidavit of prosecution. Hire a good attorney to represent your daughter.
