I was told I committed statutory rape technically by kissing a 16 year old while I’m 19 by a mall security officer. Let me first say it was consensual on both, I wasn’t forcing her to do anything. It’s been more than a week since the incident. The mall security guy never said I was going to be charged with anything, he told us just to leave. So if I was going to be charged with a crime, when could I expect something from police? He didn’t go back into his car to run anything on my name or plate that I’m aware of he just looked at my id less than 10 seconds to figure out my age and gave it back. Any thoughts? The incident with the mall security lasted not longer than a minute or two then he told us to be on our way. Thank you

To answer your question, there is no statute of limitations on sexual assault (see Texas Code of Criminal Procedure Article 12.01). That being said, kissing does not constitute sexual contact as defined in Texas Penal Code Section 22.011 – Sexual Assault and Section 21.11 – Indecency with a Child. Don’t worry about criminal charges. Worry about the fact that you are an adult; leave underage girls alone.
