Asked 8/10/2016 – San Antonio, TX

I was given done automotive parts and verbally agreed to pay for them, but I had a few unforeseen problems happen and it has set the payment back on the parts I agreed to pay for. Now the seller is threatening me with felony theft if I don’t pay up now! He also said he’s spoke with authorities and it’s a felony here in Texas! I don’t have the money and he doesn’t want the stuff back, what can I do?

Answer

Criminal charges can be filed only if the seller can convince law enforcement that a crime has been committed, and from what you describe, your situation sounds like a civil matter. Police hate to get involved in civil matters. Pay what you can, ship the rest back. If you are contact by a detective, call a local attorney.
