Sex between a 26 years old and a 16 year old is illegal (See Texas Penal Code 22.011 – Sexual Assault & Section 22.11 – Indecency with a Child) There is no statute of limitations on sexual assault cases, so criminal charges can be filed at any time for the rest of the defendant’s life. Sexual assault is a 2nd degree felony, punishable by a fine of up to $10,000, confinement in prison from 2 to 20 years, or a maximum probationary period for up to 10 years.
