Asked 1/16/2016 – Tomball, TX

My boyfriend is on 3 years deferred adjudication for possession of a controlled substance less than 1 gram that occurred in August of 2013. On his way to work yesterday morning he was pulled over and the car was searched, paraphernalia was found and he had to take the charge for it even though it wasn’t his. They booked him into walker county jail and won’t let us get him out until he sees a judge. His probation is in Houston through Harris county.

Answer

Your boyfriend’s probation officer will know about the arrest. As a general rule, a PO will run an NCIC record of a probationer before every monthly meeting. Hire an attorney to contest the matter in Walker County and contact the attorney who represented him in Harris County to see what he should do next.
