Asked 8/16/2016 – Bedias, TX

my brother was arrested in grimes county Texas and is being held with a no bond. He doesn’t have any open cases in other counties and isn’t on parole or probation, nor out on bond anywhere. What legal right does the judge have to refuse him a bond? And who or what should I do or contact to get him a hearing to receive a bond ASAP?

Answer

Retain an attorney in Grimes County who can file the appropriate motion. A bond may not have been set when your brother was originally arraigned, and I do not know what he is charged with or his criminal history; that being said, he is certainly entitled to a full hearing on the issue of whether he should be released on bond while his case is pending.
