Asked 8/16/2016 – Kaufman, TX

It is my first offense I’m a 25 false calls to the police in the past four years but they said they can only charge me with 4 because the statute of limitations only let them go back 2 years. But the police is telling me that they will still hold the 25 against me.

Giving a False Report to a Peace Officer is governed by Section 37.12 of the Texas Penal Code. That statute provides this offense is a class b misdemeanor, not a class a, so please check with your attorney to make sure exactly what you are charged with. In any event, if you are found guilty of a misdemeanor offense, the full range of punishment is available to the Court in sentencing. You could be placed on probation for up to 2 years, or sentenced to jail (up to 180 for a class b misdemeanor, and up to 365 for a class a). Your attorney is the best person to ask what will happen in your particular case.
