Driving my vehicle and pull into apt complex and police detain me and ask why I didn’t stop. Told them we had music on and didn’t know they were after me . I asked why was I being detained they said speeding. Then they searched my vehicle and said I had never been arrested and had no tickets. They arrested me and then charged me with felony evading arrest.
Answer
If an officer has reasonable suspicion or probable cause that an offense has been committed, he has the right to detain that person. If he observed you speeding, that would be a reason to stop your car. If you did not stop your car once the officer activated the lights and siren, the speeding case became an evading arrest – motor vehicle case, which is a felony. You will need an attorney to obtain the officer’s dash cam video and view your driving facts once the officer attempted to make the traffic stop .This will determine the strength of the felony case.
