Asked 8/16/2016 – Longview, TX

I have gotten four tickets within the last 12 calendar months. Two of them have been taken off of my record because I have completed my defensive driving. All four are in different cities. Will the state still be able to see all four of the tickets and suspend my license?

Answer

I believe you are referring to Section 521.292 of the Texas Transportation Code which deals with the suspension of driver’s licenses. If you are asking about suspension for being a “habitual violator”, the term is defined by having 4 or more convictions that arise out of different transactions within a 12 month consecutive period, or 7 such convictions with a 24 month period. Please note there are other possibilities of suspension under that statute. Also please note that only 1 citation in a 12 month period can be resolved via defensive driving, not 2. Be careful.
