Asked 8/17/2016 – Greenville, TX
An officer gave me a FINE for possession of paraphernalia and open container (which I had no idea someone had in the car). I gave the officer a grinder when asked if I had any paraphernalia in the car. The officer issued me a fine saying that it would not be on my record since he is with Texas wildlife as long as I pay the fine. I then asked the officer if he was aware of the price of the fine, and he estimated around $150ish. Is this true? I’m only 19, so I cannot tell my family about this issue, so I’m looking for help/information. I do not want this to be on my record.
Answer
Possession of drug paraphernalia is a class c misdemeanor, punishable by fine only (maximum $500). No fine has been assessed yet; a Judge and court of competent jurisdiction can assess fines, not officers. At 19, yet may appear in court without a parent or guardian. If you are concerned about your criminal record, I suggest you contact a local attorney from the county where you received the citation.
