Asked 8/18/2016 – Houston, TX

There is no evidence of abuse on the female. There was no witness at the trial. It was just her word against his. He stated that he didn’t hit her while in the court.

Answer

Someone was sentenced to 270 days in jail because the State proved to the trier of fact all of the elements of the offense alleged against the defendant beyond a reasonable doubt. You obviously have a personal interest in this matter, and this may be clouding your judgment in your review of this case. You state there were no witlessness at trial, then you state it was her word against his. Her word IS evidence against him. It up to a judge or jury to determine the weight and sufficiency of any evidence presented. In this day and age of social media where everything is recorded, it is easy to forget that for centuries, trials were held and the only evidence presented was the testimony of a victim. This is still possible. It is well within the purview of a judge and/or jury to believe her, not him, and enter a guilty verdict.
