Asked 1/21/2016 – Austin, TX

I got caught stealing today from HEB. I walked out the doors and as soon as I took like 3 steps this guy grabbed me. He took me upstairs and took down my info and took a picture of my ID. He also called the police and said we would have to wait for them to show up to let me go. He then sat me down and showed me two forms that he wanted me to sign. They stated the amount of merchandise which was $221 and said that if I signed I admitted to taking things from HEB. I told him that I wanted to wait to sign until the police came. He also asked for my social which I didn’t give to him either. We sat there for a good hour and the police never came. He called the police and asked if any cops were dispatched yet and they said no. He then called his boss and said that police were not dispatched yet after a hour and his boss said for him to let me go. I think he must have forgot that I didn’t sign the papers and he let me go. So I didn’t sign anything but he has my picture and a picture of my license.

Answer

It is possible for you to be prosecuted on this matter. Since the HEB loss prevention officer has your ID information, a complaint COULD be filed with the local police department and an at large warrant COULD be issued your arrest. Whether HEB will go to those lengths is up to their store policy.
