Asked 9/17/2016 – Houston, TX
I asked my probation officer to make an application to transfer my probation, felony theft, deferred adjudication home to Louisiana. A day or so later she said it was denied. I don’t think she even requested a transfer because decision was made in one or two days.
I don’t have money for an attorney. What do I have to file to get a judge’s hearing? I have viable grounds for transfer because of family ties in Louisiana, no one to emotionally support me in Texas as I am disabled.
Further, I just had surgery and the doctor recommended one year of occupational rehabilitation in Louisiana. I provided proof that my medical insurance will not cover medical or OT in Texas, only in Louisiana.
Are there any agencies that will have a lawyer represent me for free or income based in Harris County, TX?
Answer
It is discretionary with the Court on whether to transfer your probation to another state. If you do not want to retain an attorney, you have the right to appear in court and ask to speak with the judge about your request. Explain the situation about your surgery and why you desire the transfer. You may also contact the Harris County Bar Association for assistance.
