Asked 9/21/2016 – Graham, TX

no prior controlled drug charges and no warrants, etc. but they scraped the pipe to come up with less than 1 gram of meth. He has no money and is thinking about asking for a delay and getting a court appointed judge

Answer

If your son is charged with a state jail felony, he is facing a maximum fine of $10,000, confinement in jail from 180 days to 2 years, or a maximum probationary period for up to 10 years. He has the right to an attorney, and if he cannot afford to retain an attorney, the court will appoint one to represent him. Call the Court and find out what materials must be provided when requesting a court appointed attorney (check stubs, tax returns, etc.), then make sure your son appears in court as directed.
