Asked 9/22/2016 – Dallas, TX

My husband was put on probation 7 months ago for manufacturing and delivering in Dallas county. This month he was arrested for possession of a controlled substance under a gram in Irving. He was transferred to Dallas today and that’s also when they issued a warrant for his arrest for probation violation. But when he went to court even though he had a violation warrant the judge still gave him a $ 100,000.00 bond. Can he bond out?

Your husband will have to appear in front of the Court that granted his probation, and it is within the Judge’s discretion to grant a bond on the probation violation. From what you describe, however, you probably should not get your hopes up. Start talking with local attorneys about his situation before you spend the money on posting bonds. Your husband obviously has a right to a trial on his new case and may not be guilty, but if there is going to be a plea on his cases, the best you could probably hope for is SAF-P; if that’s the final outcome, posting bonds would be a waste of money.
