Asked 9/23/2016 – Dallas, TX

I am on first offense DWI probation in Dallas county. I have one month left and my friends are wanting to plan an off probation party for me. At what point am I free to “responsibly” drink and smoke? I was told by my PO that once probation ends it ends and that’s it, she said once the clock strikes 12 it’s over and I’m free. I was told that POs sometimes say things to trick you so I don’t want to fall in a trap. I have been 100% sober for the entire length of probation. However, one month I blew dirty in the interlock due to a prescribed medication and was asked about it but then was called and told that they were going to overlook it because they knew it was the medication. I would like to go back to the way things were before the arrest, except this time I’ll NEVER have even just one drink and get in the car… ever again. I have certainly learned my lesson and taught others during the process how awful the repercussions are. Is it okay to responsibly celebrate once the clock strikes 12am or do I need to wait until I see my name appear online as discharged court documents? Any advice would be greatly helpful as I definitely do not want to land in more trouble. Thanks so much!

Your probation office has given you correct information. Unless a motion to revoke your probation is filed prior, your probation automatically ends on the expiration date listed on your probation order; the court loses jurisdiction over the matter on that date.
