Asked 9/23/2016 – Houston, TX

My son is in jail charged with aggravated assault with a deadly weapon (a rock), but at the time of the offense, he had been off of his medication for several months. He has suffered with mental health issues since 2010. Your advice please.

Answer

Make sure a competency evaluation is performed on your son, as well as a full psychological evaluation. Talk with your son’s doctor and make sure all his medical records are available to his defense attorney. Stay in communication with the attorney, and you may need to obtain a power of attorney from your son in order to obtain any required medical records. Good luck.
