I have a friend who is currently on probation. Who was accused and arrested for burglary of a habitation but the case was dismissed they had the wrong person. But he did not get released instead since he missed a couple classes and failed a UA test; probation sent him to an ISF facility to do 3 months of a rehabilitation program. One month into the program he was attacked by another inmate he tried to walk away but he was attacked from behind and he defended himself. I know that there is a no fighting policy in these programs but since he retaliated he was told he’s getting kicked out of the program and sent back to the local Tarrant County Jail .he’s still currently at the facility waiting to be picked up. My question is will his probation get revoked for this? or will he possibly be sent back again to retry the program? What is the worst case scenario? And does the fact that he was attacked not matter?

Answer
If your friend is on probation and violated one of the terms of probation, like successfully complete the ISF program, then his probation can be revoked. If the probation is revoked, what could happen depends on the type of probation and the charge he is on probation for. Get with the attorney who represented your friend on the original plea.
