Asked 9/28/2016 – Atlanta, TX

First offense, 36 years old. I am very remorseful about this situation. I am facing a state jail felony conviction because of money I took from my employer, but I had every intent to pay it back. I know I was wrong but don’t want this to define me and ruin my life, I’ve worked since I was 16 and need to work to provide for my 2 kids despite my poor choices. I want a second chance!

Answer

You are eligible to receive deferred adjudication probation, but you do not have an absolute right to such probation. It must be offered by the DA in a plea bargain or granted by the Judge. Only your attorney will know if deferred is offered by the State, or if you will have to go before the Judge in what is called an “open plea”. Talk with your counsel.
