Asked 10/1/2016 – Winnsboro, TX

A friend of mine has been in Franklin County Jail in Mount Vernon Texas and his to be transferred in Lamar County Jail. I’ve already asked this question has been answered that after 10 business days not including weekends and holidays if he is not transferred they are to release him. I contacted Franklin County and Lamar County and they are not willing to release him. I need help with this now I’m going to go to the dad jail now and willing to pay for an attorney to help me with this situation ASAP I’m going to pay this attorney now over the phone for this service

Answer

There is no requirement that an inmate be released after 10 days while awaiting transfer to another county. I suggest you contact an attorney in Lamar County who can appear at the court where the warrant was issued from. See if a bond for your friend’s release can be set by agreement, or if a writ of habeus corpus need be filed in Franklin County (the habeus corpus part may sound Greek to you, but it’s a way to get the case moving). Phone calls won’t get that matter resolved. Find an attorney who is local to start doing some leg work.
