Asked 10/6/2016 – Abilene, TX

Being accused of aggravated robbery that I didn’t do. I was walking through town and undercover cops stop me go straight in my pockets search me take pictures of me and 5 hours later I’m being charged with aggravated robbery how?

Answer

The statute for aggravated robbery is Texas Penal Code Section 29.03. The State is alleging you: 1) attempted to commit a theft of property [a purse] and with the intent to maintain control of the property, 2) you placed another in fear of imminent bodily injury, and 3) you used or exhibited a deadly weapon [a gun]. Simply, if you take a purse and show a gun, it’s aggravated robbery. I’m guessing your picture was taken, shown to the victim of the robbery in a photo line-up, and you were identified and the person who took the purse. Start talking with local attorneys.
