Asked 10/5/2016 – Port Arthur, TX

I cheated on my husband and he found out… he got mad of course and he put his hands on me. I understand it’s not right for him to do this, but I don’t want him in any more trouble. He has a bad record of assault n I don’t want him back in prison. What can I do to drop these charges?

Answer

Once the police are called, you lose control over how thing will proceed. You cannot drop criminal charges, only the State can. You may file an affidavit of non-prosecution, letting the DA know that you do not what to testify in this case, but it will be up to the prosecuting attorney on whether the new case will be dismissed on not. Talk with your husband’s attorney
