I am trying to find out what kind of time someone would get if they were a wanted felon from Oklahoma and he got picked up in Colony, TX and is now in Denton County for Possession of CDS PG 1 4G<200G. I need to know what he is looking at and if once he is done serving Texas time will he go back to Oklahoma and serve time as well for having warrants and Parole violation?

Answer

Possession of a Controlled Substance in Penalty Group 1 in an amount more than 4 grams but less that 200 grams is a 2nd degree felony, punishable by confinement in prison from 2 to 20 years and a fine of up to $10,000 (see Texas Health and Safety Code Section 481.115 (d)). This punishment range can be enhanced if a person has prior felony convictions. If warrants are pending in Oklahoma for this person, he will be transferred there once Texas is done with him.
