Asked 6/14/17 – Pasadena, TX
I was arrested with 2 other people and charged with Class A Theft. I’ve never been arrested before.
Answer
In reverse order: 1) Yes, you CAN get the criminal case pending against you dismissed. Any criminal case can be dismissed, but whether a case WILL be dismissed depends on the specific facts and the evidence the State has in its possession. 2) You can remove a matter from your criminal record only if a final conviction is never entered on the case. If you are found guilty, for all intents and purposes, it will never be removed. 3) You avoid jail and/or reduce fines by either being found not guilty at trial or, before trial, reaching a plea bargain agreement with the DA. I understand your anxiety over this situation, but it is too early in the process for you the get final answers. Start talking with local attorneys, make your required appearances at court, go through the process and discover what options are available. Good Luck.
