Asked 6/21/17 – Fort Worth, TX

My son was on felony probation in Florida for a concealed weapons charge. He was to be on probation for 3 years. After 1.5 years he was allowed to transfer his State probation to Texas. He violated probation recently (only 1.5 years left – sigh). If he ends up going to prison (likely) will he be in Texas or sent back to Florida? Any thoughts as to how long? I have heard 3 years, but….

Florida retains jurisdiction of your son’s case, so if he is sent to prison, it will be in that state. Since Florida law governs his case, you will also have to ask an attorney licensed in Florida about what his potential jail exposure is. Good Luck.
