So I recently received noticed that I would be considered for a great job opportunity in which I will be receiving notice of when I need to complete my drug test and finger printing. It is with a large bank. I was never asked about criminal history other than that of SEC, FTC issues on the application. However, when I heard finger prints I worried about me receiving a felony deferred adjudication (non-violent) back in 2005. It was completed 2 1/2 to 3 yrs later successfully and I received notice it was dismissed. Worried if it would come up 10yrs later I paid for a search on Tx DPS Crime Search and it returned no records for me after a search of 3 different variations of my name & DOB – i.e. no arrest, no probation, nothing. I have always though about expunge/non-disclosure but just haven’t as I have never had any issues with jobs or becoming a tenant other than when I was actively on probation. Should I worry about this coming up on the finger printing background check, especially if TxDPS Crime Search holds no records for me? Other than that 2005 incident I have never had any other issues or arrest.

Existence of a dismissed case will generally appear on a standard background check. If the case was dismissed after successful completion of deferred adjudication, you really should contact a local attorney about filing a petition for non-disclosure on your case. Good luck.
