My daughter has an arraignment on July 7
for 300.00 credit card abuse. How much time can she get for this crime? It is not her first offense. 2016 it was a misdemeanor. She is bi-polar can she get help while in jail?
These things will keep happening if she does not get some help.

Answer

The statute for credit card abuse is Texas Penal Code Section 32.31. It is normally a state jail felony, punishable by confinement in jail from 180 days to 2 years. This punishment range can be enhanced, however, if a defendant has prior convictions. Make sure you bring your daughter’s mental health issues to the attention of her attorney. Provide her/him with as much medical documentation as you can regarding her diagnosis and see what alternative sentencing is available in this case. Good luck.
