Asked 6/27/17 – Dallas, TX
I never received nothing in the mail of this situation occurring. My son never told me. And he was not living with me at the time. I am also aware I was his legal guardian and am responsible for him. But how do I try to fix something I was never aware of. Now I am told I must pay $507 in 30 days or my license will be suspended.
Answer
You definitely should investigate this matter; if your son was 17, he has the ability to appear in court without a parent or guardian on a citation. That being said, since he can appear on his own, HE is responsible for the disposition of any such citation and any fines associated therewith, not you. The statute of limitations, however, is tolled when the charging instrument is filed with the court, so it probably does not apply in your situation. Contact an attorney in the county where the citation is pending to see what is going on.
