If a 17 year old fixing to be 18 in July gets involved with a 16 yearl old which she is fixing to be 17 in October can he face statutary rape charges.. or what can actually happen

Answered 9 minutes ago. “Fixing to be” any age doesn’t count, the question is the age of the parties at the time of the act. See Texas Penal Code Section 22.011 – Sexual Assault, Section 21.11 – Indecency with a Child, and Section 43.25 – Sexual Performance by a Child. There may be some defenses to an act as you describe, but criminal prosecution is a possibility
