Asked 7/7/17 – Austin, TX

I was pulled over recently with a friend and the police smelled marijuana. We were both detained and my friend was arrested for having 1.5 grams of pot. I was given a citation for paraphernalia and speeding. The thing is I have 3 tickets and I am on deferred adjudication for a restricted felony class C. Could I be facing probation or jail? I am also only 17. The judge knows me well too and doesn’t like me as it is so this may play a factor in my fate as well.

Answer

I do not know what a “restricted felony class c” is, but possession of drug paraphernalia is a class c misdemeanor, punishable by a fine of up to $500 plus court costs. I agree that if a Judge in a criminal court personally knows you from past experience, it could play a factor in any new case before that court. Start talking with local attorneys.
