Husband violated parole by catching new misdemeanor family violence charge. His parole discharge date is July 7th. He waived his right to a parole board hearing what happens when he discharges will he be released on that day can they still hold him past that day?

Answer

If a motion to revoke parole is filed before the expiration of parole, the discharge date no longer applies. A violation one month, one year or one day before parole expires is still a violation which can cause revocation and return to prison. There is no more discharge date once there is a revocation.
