Asked 7/21/17 – Austin, TX

Probation wanted to extend my probation another year due to a UA dirty that was given back to back one day after the first UA I will not do any more probation. My fees are paid how much time will I possibly get if they allow me to use my back time?

Answer

Time served in jail as a condition of probation and time at an in-patient facility does not count towards back time on a jail sentence. Any sentence imposed in your case depends on whether you are on straight or deferred adjudication probation. Contact the attorney who represented you on your original plea to determine your exact back time and your options.
