Asked 8/15/17 – Harlingen, TX

my husband has not been in trouble he went to see his uncle who owed him money went to collect the money so it was called a criminal trespassing he served time for that then they checked his background check and he had an assault charge back in 2015 for not showing up for that case they gave him 48 months will he be out before that

Answer

Once sentenced is imposed on a criminal case, jurisdiction of the matter is transferred to the Department of Corrections (if your husband was sentenced to 48 months, then his case was a felony). It is up to the Department of Corrections, specifically the Board of Pardons & Parole, to determine his release date; neither a Judge, prosecutor or defense attorney can tell you how long an inmate will actually serve. Once he is transferred to a TDC facility, you can look up his estimated release date on the TDCJ website. Good luck
