Asked 1/26/2016 – San Antonio, TX

I was “charged” with a DWI back in October, then “charged” with public intoxication in Dec. I don’t know why I’ve had such bad luck in that short of a time but both situations, didn’t have to be that and cops didn’t have to go down that road but that is exactly what happens when you trust people you barley know. Learning lessons I guess. I’ve been super careful since. Due to suspension of DL. For the record I am not a problematic/trouble some person.

Answer

The DWI will not be enhanced by the public intoxication; however, if the DA on your DWI knows of the second alcohol related violation within a few months, he or she will assume you have a drinking problem and will probably adjust any plea recommendation accordingly. You will need an attorney. Have that attorney represent you on both cases and map out a general plan.
