Asked 1/26/2016 – Austin, TX
I was arrested in Austin for a DWI. The arresting officer gave me my field sobriety tests multiple times before breathalyzing me. I refused the breathalyzer and was taken to jail for blood. I spent just under 20 hours in jail and still have yet to receive the results from my blood test. Should I plead not guilty?
Answer
I can’t represent you over the internet, so I can’t tell you exactly how to proceed. I suggest you retain a local attorney, let that attorney obtain copies of the evidence against you (the blood test results, the arresting officer’s affidavit, the videos taken at the time of your arrest, etc.), and, after you have reviewed these materials and received a plea bargain offer from the DA, then you can decide on whether to have a trial or not.
