Asked 1/27/2016 – Round Rock, TX

My name is megan andrews and I want to sign a affidavit of non prosecution to not press charges for a class c misd. assault. The prosecutor told him that I would need to write a statement to not press charges and get it notarized.. I’m so confused and I need some help.. If I live in Round Rock, Texas, where can I go with my statement to get it notarized? Can I handwrite it? And what do I need to bring with me when I go to get it notarized? Also when I do get it notarized, what steps do I take next? I need to know as soon as possible what I need to do because I’m leaving to go out of town tomorrow and wont be back until after his court date. The prosecutor also said I wouldnt have to be present on his court date. Please email me back or leave me a voicemail!! I’m at work at the moment and cant take phone calls..

Answer

If the defendant in this case has an attorney, have that attorney prepare the affidavit of non-prosecution. You don’t’ need to stress out over this situation. You are not charged with anything. If the defendant does not have an attorney, call the prosecutor back, ask him or her to send you a form for the affidavit, if he or she refuses, go on about your business. Thus is not your problem.
