On January 9, 2016 approximate time 2230 hours/or there about;my spouse decided to see what it would feel like to punch me in the face. We hadn’t been arguing, in fact we were enjoying the evening. Of course, my reaction to being hit in the face abruptly, was to retaliate and I got angry. He ran out of the room to hide from me in our home we currently reside, when I approached his custodial step grandchild from his deceased wife’s daughter;which makes her his step daughter;the 16 year old jumped up when I asked where was he hiding? The teen enraged, calling me every name in the book and pushing me and hitting me, from my left my spouse tackled me causing injuries to my head back and neck. The police were called since I was pinned down, didn’t get a chance to call 1st, so the police took the word of the 3 males living in this home over me. I was taken away without a coat, keys or id for a 48hr detainment. I ended up in a State Hospital with the criminally insane and there too was attacked on my head. Now I find out that I have to go to court to plea and that I was the ACCUSED and that the others were the victims. I did go to E.R., where DR. noted I am the Crime Victim by the wounds.
Answer
If a criminal charged is filed against you, you have to go through the process. You must hire an attorney, enter a plea of not guilty and present your evidence to a judge or jury. You have your version of the story, but so does everyone else who was in the house. They will have the change to present their version of the events as well, and a decision will be rendered by the trier of facts.
