Asked 1/30/2016 – Baytown, TX

I was parked already when the cop turned on his lights saying my window tints were too dark he said he couldnt see how many people were in the car and my windows were rolled down half way. He also said my back windows could be as dark as i wanted them. isnt there a law stating a cop cant pull u over for something and get you introuble for something else. By the way he only wrote no license on the citation and not the reason he pulled me over. Can i just tell the judge this ?

Answer

No, there is no such law. Once you are stopped, an officer can issue citations for any violations he observes. For example, if you were pulled over for speeding, then and officer observes drug paraphernalia in your car, you could receive citations for either offense or both. Whatever citations that are issued are done so at the officer’s discretion.
