Asked 2/1/2016 – Round Rock, TX

My boyfriend didn’t get an affidavit of non prosecution in at all and my pre trail date is today at 2:30 pm. Would I be able to call the court and ask for a reschedule for my court date so that when my boyfriend gets back into town from a sudden death in the family, he is able to get it notarized?? Need answers ASAP!

You must appear in court today in person; failure to appear may cause a warrant to issue for your arrest. Whether your case will be reset depends upon how many settings the case has had. What does your attorney say about how you should handle this situation? Were you informed that an affidavit of non-prosecution does NOT mean automatic dismissal of the case? Show up today and request the reset.
