Asked 2/2/2016 – Hempstead, TX

Was driving someone else’s car while he was in the car from San Antonio to rockport to help move since his license was expired I drove for him, his car was also previously registered and recently transferred title from a common convicted drug user whose name was still registered, I was pulled over in atascosa Texas for a bogus reason j asked if they could search car I answered no problem, I stood off to the side w my dog and they searched through this mans trunk n belongings and found paraphernalia and claimed it to presumably be mine, I stated it was not mine, Owen of the car stated that the car was recently given back ownership to him by a judge and that she had not cleaned all of her belongings and he also affirmed that these items were hers not mine, I got a ticket I failed to appear and I was wanting to fight it, but I have been homeless and trying to get back on my feet in a very far away town without transportation and forgotten abt the date on the ticket being last week.

Answer

Your are probably going to have to retain a local attorney to help you. First to remove the warrants and second, to defend you with respect to the possession case Make sure you obtain a copy of the vehicle registration in effect at the time of the stop, showing the registered owner of the car. You are going to have problems, however, with the failure to appear citation; “I forgot about it” won’t fly.
