Asked 2/4/2016 – Tioga, TX

In 2004 a person received a public intoxication citation. It went to warrant in 2007 with the proper complaint filed. Nothing was touched. In 2015 a letter was received saying this now warrant needs to be cleared up. A hold is now on the driver license.

Answer

The statute is tolled upon filing of the case. If the complaint against you for public intoxication was filed with the court within two years of the date of the offense, then the statute of limitations does not apply. There are other legal defenses that may apply, however, so contact a local attorney to clear the warrant, remove the hold on your license and address that PI charge.
