Asked 2/4/2016 – Conroe, TX

So I had a bunko attorney, the man said he would do my early termination of probation as soon as I was eligible. Well a month after I was eligible he refuses to respond to emails or phone calls. I have since taken matters into my own hands. I called the courts and was directed to someone at the probation office, I assume a supervisor over there or something. I spoke with her about early termination and she was very nice and told me to write a letter saying as to why I deserve the early termination, the lady at the probation office said she would speak to my officer as soon as our call ended. So today I go into the probation office and she did the application for early termination and took my letter, my officer likes me and thinks I’m a good guy. So my question is, given how my officer is recommending me and sending all my files in, how long should this process take? I know it all has to do with work load of the judge but I just want a good estimate because I don’t want to be left wondering what is happening.

The process really didn’t begin until something was filed with the court. Normally, a motion for early discharge from probation is filed, the matter is placed on the court’s docket, which puts a deadline on the probation department and the District Attorney’s office to file any objections. Right now, I assume your file is in a stack sitting on a clerk or the Judge’s desk, and it will be attended to when someone goes though the stack; there are no deadlines.
