Asked 2/10/2016 – Amarillo, TX

I am on deferred felony probation. I failed a UA and my po filed a motion to adjudicate. I am not wanting to be reinstated with probation. A warrant was issued and I turned myself in and did a walk thru with a jail card issued by the judge. I am on bond and my only bond conditions are to call in to bondsman weekly and obey Texas laws. My po called and threatened to forfeit my bond for not reporting but she filed an mtag!

Answer

While you are on bond, you are required to do anything a Judge tells you to do. You are on probation which has yet to be revoked, so you must do anything your probation officers tells you to do. I am a little confused about the sequence of events. A motion to adjudicate guilt was filed, a warrant was issued and you posted bond, and while out on bond you failed to report and ANOTHER motion was filed? If there is an outstanding warrant for you and you do not want to be on probation, go up to court during normal business hours, tell the Judge you do not want to remain on probation, turn yourself in and begin to serve your prison sentence, You may be looking at a lot more than what you think, so contact an attorney before you do anything.
