Asked 2/13/2016 – Euless, TX

I received a speeding ticket in october on the freeway, a 76 in a 60. The Officer did not write any field notes on the ticket of what happen, the prosecuter told my attorney that it was doutiful to get a video. Lastly, the officer radar me 415 feet away. Deciding if going to jury trial will be a good idea or not.

What does your attorney say? The information you provided does not address the issue. Were you traveling 76 in a 60 on the date and time in question? If you don’t believe you were, have a trial and tell the jury your version of the events. Do NOT, however, count on the officer screwing up testimony. Remember, they are professional witnesses; they testify in court in the normal course and scope of their employment. Speeding tickets were successfully prosecuted long before there were videos, so don’t think that the lack of a video gives you an out. Address the substantive fact of whether you are guilty of the accusation, then go from there.
